Terms of Use for the AI Assistant

The following provisions govern the use of the AI Assistant provided by InfoGraph GmbH (the Provider) by InfoCAD software users (the User).
§ 1 Technology, Scope of Services
(1) The AI Assistant answers questions about the InfoCAD software system. In doing so, it uses RAG technology (Retrieval-Augmented Generation) based on AI language models (Large Language Models, LLM).
(2) The AI Assistant is trained using the documentation of the InfoCAD software system as well as the content of the Provider’s website and is continuously updated. Communication between users and the AI Assistant is not included in the training.
(3) As with other AI Assistants (chatbots), the answers may contain errors due to system limitations. In cases of doubt and for technical advice, the provider’s support team should be contacted.
§ 2 Use, Suspension
(1) The AI Assistant is available exclusively to licensed users while they are using InfoCAD. It is not permitted to make the AI Assistant available to unauthorized third parties.
(2) Questions posed to the AI assistant must not contain any personal information, trade secrets, or data that infringes on third-party copyrights or other intellectual property rights. The user indemnifies the provider against all claims arising from any such infringements.
(3) In the event of misuse, such as a violation of the aforementioned provisions, the provider may block access to the AI assistant.
(4) In the event of criminal content, the Provider reserves the right to forward such content to law enforcement authorities.
§ 3 Provision, Costs
(1) The provision of the AI Assistant is subject to change and does not establish a legal claim to future availability.
(2) Use of the AI Assistant is free of charge for authorized users until further notice.
(3) The Provider reserves the right to change or restrict the authorized user group as well as the nature, scope, and availability of the service without notice.
(4) The service may be expanded to include fee-based services within the framework of existing or additional contractual provisions.
§ 4 Limitation of Liability for Content
The responses generated by the AI Assistant are created automatically using artificial intelligence. The Provider makes no warranty as to the accuracy, completeness, timeliness, or reliability of the information provided. The responses are intended solely for general informational purposes and do not constitute individual advice.
§ 5 General Liability
(1) The Provider shall be liable without limitation for damages resulting from injury to life, limb, or health caused by an intentional or negligent breach of duty.
(2) The Provider shall be liable for other damages only if they result from an intentional or grossly negligent breach of duty.
(3) In the event of a breach of material contractual obligations (cardinal obligations), the Provider shall also be liable in cases of slight negligence, but limited to foreseeable damages typical for this type of contract.
(4) Any further liability is excluded. This also applies to the liability of employees, representatives, and vicarious agents
§ 6 Personal Data Processing
(1) To protect against misuse as defined in § 2, the user’s IP address is stored in accordance with Article 6(1)(f) of the GDPR.
(2) In order to operate, the AI Assistant uses services of Chatbase® Inc., 2261 Market Street, STE 85690 San Francisco, CA 94114, USA. The questions entered and the corresponding AI responses are recorded for quality control purposes. By using the AI Assistant, the User agrees to the data collection and processing by Chatbase Inc. in accordance with the Chatbase Privacy Policy.
(3) The history of communications between the User and the AI Assistant is stored on the User’s computer in their user account. The history can be deleted via the AI Assistant’s context menu.
(4) The user can demand information about his personal data being stored by the provider. Furthermore, he has the right to correct, delete or block these data. He may also object or restrict the processing of his data. The contact form and the email address privacy@infograph.eu are available for such inquiries.

§ 7 Severability Clause
Should any provision of these Terms of Use be found to be invalid, the validity of the remaining provisions shall remain unaffected.
